In a business world, the name of a business is important. It can have its own life, its own reputation. Sometimes, the name can already assure profits. At times, the names may, despite its excellent product or service, bring wrong perceptions to the target market and affect its profitability.

In Singapore, ACRA set rules in evaluating a name for a business before the business itself is registered. In its Business Name Guide, ACRA made clear of three indicators in approving a business.

“A business name should be unique and without resemblance to another business. When it is registered and established, a business is not mistaken for another,” says Rikvin’s business consultant referring to one of the rules in business name assessment.

Rikvin adds: “When complaints start to pour in, either ACRA or the court shall make the resolutions. Minor glitches such as typographical can be resolved by ACRA. However, if it concerns about mistaken identity of a company because of close resemblance in business names, the court shall make the decision.”

Changing of a business name can spell losses especially if reputation from such name has been established. Even if the business is still new and it has been ordered by the court to change its name, it can have bad effects.

“People might wonder the reason for changing a business name and may start to doubt the reputation of that business,” the business consultant explains.

The other rule in assessing the business name is its conformity to existing laws including trademarks.

“Trademarks are upheld. Thus, a business name that violates trademarks is not approved. Temasek for example is a registered trademark and so it is exclusive,” says the business consultant.

“Names should also conform to the morals of the society. Obscene names of course are not approved,” says Rikvin continuing to shed light on the process of business name evaluation.

Moving on, if a proposed name is available, the investor can choose to register or reserve it. Reservation holds valid for two months. If for some reasons, the investors are not ready yet to register after the two-month reservation period, they can request for an extension to ACRA.

“Registering a name is a requisite. When registered, ACRA shall issue via an e-mail a notification about the registration. It will also attach a Certificate of Business Name,” says Rikvin.

Rikvin provides free business name check services as part of its specializations. It devoted a page on its website for an online application so investors can propose two names for evaluation.

“After we receive the request, our team works on it and get back to the client for the result,” chimes the business consultant.
